Appeals Court Upholds Dismissal of NYC Graphic POS Tobacco Signs
The U.S. Court of Appeals for the Second Circuit yesterday upheld a 2010 district court decision striking down a New York City resolution requiring that retailers who sell cigarettes display signs containing graphic health warnings. The appeals court agreed with the trial court's ruling that such requirements were preempted by federal law. Altria news release.
